It's he-said, she-said on the first day of the Cracker Barrel beating trial in Clayton County. In opening statements, Troy West's defense attorney told the jury that Army reservist Tasha Hill (right) has a temper, and that she threatens people when she argues with them. But Hill testified that it was West who went off on her about the Cracker Barrel restaurant door, calling her a "f** n b**" and hitting and kicking her--all while she heard her seven-year-old daughter screaming nearby. Hill denies spitting on West. The 47-year-old West faces up to 10 years if convicted of aggravated assault. His lawyer says surveillance tape from the restaurant will show what really happened.
He's Gwinett County's longest-serving county commissioner, and his next long stint could be a prison term. Kevin Kenerly is expected to surrender to authorities as early as today after being indicted on three counts following a probe of shady land deals in Gwinnett County. Kenerly, a married father, is accused of accepting or agreeing to accept 20 $50,000 payments from developers in exchange for rezoning votes on the commission. A conviction on all charges would bring a maximum sentence of 22 years behind bars.
The Fulton County trial of Aimee Michael is starting and the defense is already taking center stage. Michael's lawyer admits she took off after last year's Easter Sunday wreck on Camp Creek that killed five people, and that she lied to police. But he says, she didn't cause the crash; the 24-year-old is claiming that another car hit her BMW first. The 24-year-old rejected a 50-year plea deal. Michael's mother, Sheila, pleaded guilty Monday to helping her daughter hide evidence.
Election Day is already over for more than 3 million Americans, and a surprising number of them are Democrats. Early voting figures give Democrats an edge in a number of states and big counties. A Georgia political analyst says Democrats aren't just going to "roll over" in the midterm elections.
Another recall for Toyota--this one over leaky brake fluid and fuel pump problems. In the United States, the recall covers a range of Avalon and Lexus models. Owners get letters next month notifying them to bring in their vehicles for repair.

Dr. Andrew Hyland with the Roswell Park Cancer Institute says apartment doors are poor filters of secondhand smoke. "In this shared building space, they are at potentially at risk if someone on the 18th floor is puffing away," says Hyland. Thousands die each year of cancer and other diseases from secondhand smoke; doctors estimate 40% of kids are exposed to it. Hyland supports smoke-free apartment buildings.
Federal prosecutors charge an armored car company employee with being the inside man on a robbery. The driver of the Loomis truck robbed outside a DeKalb hospital says he heard the lock disengage on his truck and turned around to see two masked men getting into the secured compartment and taking off with bags of cash. They fled in a waiting U-Haul truck but left the master key behind. Police say that master key had been missing ever since 28-year-old Okevlibus Thornton had last driven a shift; he was arrested a short time later.
Two armed men who robbed the CVS Pharmacy across the street from Piedmont Hospital in Buckhead early this morning weren't interested in the cash register. They went straight for a couple of bottles of Promethazine cough syrup, which is often used to make the street concoction "purple drank" or "syzzurp." The codeine-laced syrup often mixed with soda, cognac and Jolly Ranchers is the drink tied to rapper Pimp C's death, and ex-Raiders quarterback JaMarcus Russell's summer arrest.
Get ready to Google the Dead Sea Scrolls. Google and the Israeli Antiquities Authority are teaming up to make the first comprehensive and searchable database of the 2,000-year-old scrolls, which hold the oldest surviving copy of the Ten Commandments. Web surfers will be able to see exact copies of the originals, and get English translations--all for free. Most of the time, the scrolls are housed in a dark, climate-controlled room at a Jerusalem museum.

Mississippi has the highest teen birth rate; Georgia ranks 11th. Among non-Hispanic blacks, however, teen pregnancies are actually highest in the midwest.
